Welcome to GetRugby, a digital coaching platform owned and operated by Urbsub Marketing (Pty) Ltd, registration number 2021/815033/07, incorporated in the Republic of South Africa.

 

These Terms and Conditions ("Terms") govern your access to and use of the GetRugby platform (the "Platform"), including all content, functionality, and services available via www.getrugby.com or related digital channels. By accessing or using the Platform, you agree to be bound by these Terms. If you do not accept these Terms, you may not use the Platform.

1. Definitions
"GetRugby" refers to the Platform, including all digital services, rugby-related content, and coaching resources.

"We", "us", "our" refers to Urbsub Marketing (Pty) Ltd.

"You", "your", "user" refers to any person accessing or using the Platform.

"Content" means all materials on the Platform, including videos, articles, graphics, software, and other media.

2. User Eligibility
You must be 13 years or older to use the Platform. If you are under 18, you confirm that you have obtained permission from a parent or legal guardian.

 

3. Registration and Account Security
To access certain features, you may need to register an account. You agree to:
3.1 Provide accurate, complete, and current information during registration;

3.2 Keep your login credentials confidential;

3.3 Notify us immediately of unauthorised account access or suspicious activity.

3.4 We reserve the right to suspend or terminate any account that breaches these Terms or applicable law.

 

4. Acceptable Use
You agree not to:
4.1 Use the Platform for unlawful, harmful, or fraudulent purposes;

Copy, modify, reproduce, distribute, or commercially exploit content without authorisation;

4.2. Upload malicious software or disruptive content;

Harass, threaten, or harm any other users or our staff.

 

5. Intellectual Property
5.1 All intellectual property on the Platform—including copyrights, trademarks, logos, and proprietary content—is owned by or licensed to Urbsub Marketing (Pty) Ltd.

5.2 You are granted a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial purposes only.

5.3 You may not:
Modify, resell, republish, or exploit any portion of the Platform;

Use our branding or content without prior written consent.

 

6. User-Generated Content
If you upload or submit content to the Platform (e.g. comments, feedback, videos):
6.1 You retain ownership of your content;

6.2 You grant us a worldwide, royalty-free licence to use, display, reproduce, and distribute your content in connection with the Platform;

6.3 You confirm that your content does not infringe on third-party rights and complies with these Terms.

 

7. Privacy and Data Protection
7.1 We collect and process personal information in line with the Protection of Personal Information Act, 4 of 2013 (POPIA). By using the Platform, you consent to such processing as described in our [Privacy Policy].

7.2 While we take reasonable steps to secure your data, we cannot guarantee absolute security.

 

8. Subscription and Payments
8.1 Some features or content may require a paid subscription.

8.2 All fees are disclosed prior to purchase;

Subscriptions are billed annually and upfront;

Pricing may change, but no changes will affect existing paid periods without notice;

9. Termination
We may suspend or terminate your access without notice if you breach these Terms or any applicable laws.

Content is always accurate, up to date, or suitable for your needs.

11. Limitation of Liability
To the fullest extent permitted by law, Urbsub Marketing (Pty) Ltd will not be liable for:
Any indirect, incidental, or consequential damages;

Losses arising from your use of or inability to use the Platform;

Damages caused by unauthorised access or changes to your data.

 

12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa, which shall have exclusive jurisdiction.

 

13. Changes to These Terms
We may update or modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Platform after such changes means you accept the revised Terms.

14.1 Prohibition on Competing Platforms
By subscribing to or using the GetRugby Platform, you agree not to directly or indirectly develop, launch, or assist in the creation of any competing product, service, or platform that offers substantially similar digital coaching features, curriculum, or user experience for a period of 12 months following your last access to the Platform.

14.2 Scope of Competition
This restriction applies globally and includes (but is not limited to) any platform, app, course, or program focused on digital rugby training, online rugby coaching, or similar educational experiences derived from or inspired by GetRugby.

14.3 Intellectual Property Reservation
Even if certain features, materials, or concepts are not formally registered as intellectual property, we expressly reserve all rights, title, and interest in and to any proprietary content, ideas, systems, processes, and features presented or made accessible through the Platform. No license or ownership interest is transferred to you except as explicitly stated in these Terms.

14.4 Breach and Remedies
Any breach of this clause may result in immediate termination of your access to the Platform and may subject you to legal action, including but not limited to injunctive relief, damages, and recovery of legal costs.
